Apparently, U.S. judges are just as unspeakably incompetent as Ontario judges.

But when something that monstrously stupid gets to the appeals court, normally, those judges don't like to look like utter asshats and they will have more incentive to try to look sane, and are more likely to kick idiocy like that to the curb.

Sadly, it does not work that way in Ontario, where judges on the Appeals Court are just as monstrously stupid as lower court judges.; 10:35 AM
