Chronicles of Twatrick: The final accounting.

Since all the necessary judgments have been rendered and rulings issued, and papers filed to start collection proceedings against Patrick "Outlaw Debtor" Ross, unless there are some massively entertaining developments, there's not much point in continuing the regular Patrick-related smackdowns, other than to tally up his current (and growing) debt.

First, there is the August 19, 2021 fiat of J. McMurtry, starting things off with establishing Patrick's basic debt based on my 2010 judgment against him:




So that's the base debt: $103,326.03. But it doesn't stop there.

Given the new post judgment interest rate of 5% (up from 2%), what Patrick owes me is increasing currently at $5,166.30 per year; for the sake of simplicity, let's just call that $400 a month, and since the fiat allowing me to register my judgment in Saskatchewan is dated Aug 19, that means Patrick is already into me for two and a half months of additional interest, or $1,000. Add that to the bill. But we're still not done.

Note that, for this application, Patrick's response was such utter rubbish that I was awarded enhanced costs of $3,000:




That amount is separate from the above, and it's not clear that it is also subject to the 5% interest rate, so let's just call that a flat $3,000 and move on.

Pile on top of that approximately $4,500 in unpaid cost awards going all the way back to 2012; again, it's not clear if that is subject to the interest rate, so call that a flat $4,500 and add it to Patrick's tab.

Finally, as I have mentioned before, the Saskatchewan sheriffs don't work for free; they bill for their activities and, even though they have just started, they have already documented about a thousand dollars worth of work, all of which will be passed on to Patrick, and which could conceivably reach into the many thousands of dollars, depending on how aggressively Patrick dodges and weaves and avoids service and conceals his assets. Since I have no idea what the final amount there will be, we can just leave it out but remember that it will be there in the end.

The tally? Based on my math, just under $112,000, plus whatever the sheriffs bill -- a total amount that, given Patrick's current hiding out in the wilds of Northern Alberta and refusing to deal with this, is growing by $400 a month.

So until anything new and exciting comes along with respect to this, we can put it to the side and move on.

If we were Patrick Ross, we'd settle for every penny first thing Monday morning. This is only going to get worse for him every single day until he pays off his debt in full.

Then again if we were Patrick Ross...

...we wouldn't have written multiple defamatory blogs in the late aughts.

...we would have deleted those blogs after receiving a libel notice.

...we would have settled for less than $10K in the early stages of the legal proceedings.

...we would have tried to mount some sort of defense in court of our position, instead of taking a summary judgment.

...upon receipt of the summary judgment, we would have taken the appropriate legal action to try to be let back into the case so we could argue our side.

...we would have paid the just $85K judgment immediately.

...we wouldn't have declared bankruptcy

...after shamefully declaring bankruptcy, we would have fully complied with the terms of our bankruptcy, making regular payments to my trustee.

...we wouldn't have been so non-compliant, that our bankruptcy trustee resigned.

...we would have paid the balance of the $34K bankruptcy judgment.

...we wouldn't have left ourselves as an undischarged bankrupt for years.

...we wouldn't have gotten our ass kicked in a Lloydminster street fight.

...we wouldn't let interest and cost awards accrue so I now owe my worst enemy $112K+ (and counting!).

...we wouldn't have picked a fight with Mr. Skinner, leaving myself vulnerable to more costly legal smackdowns.

Fortunately, we're not Patrick Ross. I think all of us, no matter where we are in life (except Patrick himself, who of course reads this blog obsessively) can thank jeebus that we are not Patrick Ross.

At any rate, seems reasonable. Let us know when some possessions actually get seized or some wages tracked down and garnished.
