16 days and counting ...

Barring an appeal, 16 days from now, my default defamation judgment against one Patrick Ross of Lloydminster will be registered in Saskatchewan:




at which time I am assured that the Saskatchewan sheriffs will take over and begin the process of locating and seizing Patrick's stuff (all, I should mention, at Patrick's expense). Concurrent with that will be a legal search to identify any and all assets that Patrick is attempting to conceal, such as farmland inherited from his grandfather that was reportedly signed over to a close relative to hide it from me.

Of course, Patrick has the right to appeal this recent ruling, but given the absolute spanking he got from the judge regarding his utterly meritless argument opposing the registration:




the most likely outcome of any appeal would be another crushing defeat and even more enhanced costs. I guess we'll know in 16 days.

Does this mean that Patrick Ross needs to come up with the ENTIRE ~$115,000 in 16 days, or else you can begin forcible collections in the Lloydminster area entirely at his expense?

Like, even if he somehow came up with $20K in good faith, or promised to let you garnish wages from his temporary forestry job in Grande Prairie, at this point, it's too late? As in, you could forcibly collect debts even if he miraculosuly managed to reduce the total monies owed?

Once my judgment is registered, I am free to collect until Patrick's debt to me is satisfied in full. This means seizing all assets, including any inheritance, which includes any property that was left to him, and garnishing all wages. In addition, Patrick will remain an undischarged bankrupt -- with all of the associated restrictions and limitations -- until his debt to me is paid in full.

Wow. Patrick Ross is so, so screwed. But he totally deserves it, and not only because he maliciously defamed you. But also because Patrick "tapped out" into bankruptcy and was given a second chance by the courts, then contemptuously and cowardly failed to meet those lenient expectations.

If he's smart, he'll get Daddy Ken Ross to co-sign a loan to pay you in FULL and avoid this ignominious fate. Collection costs - not to mention the humiliation of big, bad CC continually extracting pounds of flesh from flabby Twatrick - make the bank a much more pleasant creditor than CC.

Patrick is an undischarged bankrupt - he won’t get a loan of any size even with a co-signer on it, much less one for north of $100K.

His Dad might be able to take out the loan, but he’s on the hook for it himself then, not Patrick … and if I were in Dad’s shoes, I’d be thinking “Son, you made your bed, now you get to lie in it.”

… and even when CC collects the full amount, Ross remains an undischarged bankrupt … with no Bankruptcy Trustee … which kind of leaves him in a limbo that will be difficult to sort out. All that will have disappeared is CC’s objections to having his bankruptcy discharged by the courts ….

MgS: Mostly true, except that once I collect the full amount owing to me, it should be a simple matter for Patrick to apply to bankruptcy court to have the bankruptcy annulled. The most direct way out of bankruptcy is to simply pay your creditors the full amount owing.

However, Patrick is in a much deeper hole than most bankrupts for lots of reasons, some of which I have not talked about. Yet.

In any event, Patrick is in the unenviable position of being a bankrupt subject to the onerous restrictions of bankruptcy, while not being afforded the protection of bankruptcy. He really is in the worst of all possible universes -- all the drawbacks of personal bankruptcy, with absolutely none of the benefits. And life is about to get much, much worse.

@CC @ 4:46: Just looking in from the outside, I don’t imagine the bankruptcy courts are going to be terribly happy with some of his antics with regards to the bankruptcy itself - not taking your obligations under the law seriously is generally frowned upon. I imagine he will have … some difficulties … getting his bankruptcy annulled.

As for other aspects of his case - well - I imagine those are a reflection of his character.
