Marc Emery and abortion rights.


If U.S. Supreme Court nominee John G. Roberts is confirmed, and if he helps to overturn Roe v. Wade making abortions illegal again so that abortion providers in the U.S. could be prosecuted, and if pregnant women who want abortions then come to Canada to get them, would the U.S. demand that Canadian abortion doctors be arrested for breaking American law in Canada?

Just asking.

(I know it's not a perfect analogy, I'm just curious where the line is being drawn.)

And suppose the Americans didn't have enough Canadian content on their TV and radio stations... could we get somebody arrested for that too?

Depending on how an abortion law was written in a post RoeVWade era the woman could face charges for deliberately killing an unborn child but as long as the procedure was performed in Canada and there were still no laws preventing a Canadian doctor from performing it then the Dr. would be free from any charges.

If Mr. Emery had sold drugs to Americans in Canada then there would be no justification for the DEA to seek his extradition. Once the interstate trade occurred with the final destination in the US he broke their law and should face trial.
