So basically Judge Bates is saying his court is the right court, or his courst doesn't have the proper jurisdiction, or he is saying, I don't want to touch this case with a 10 foot pole.

This is hardly a victory for the defense, just a failure to engaging for the Miss Plame.

When you pointed this out, first thing I wanted to know were the grounds for the dismissal

U.S. District Judge John D. Bates said that Cheney and White House aides cannot be held liable for the disclosure of information about Plame in the summer of 2003 while they were trying to rebut criticism of the administration's war efforts levied by her husband, former ambassador Joseph C. Wilson IV. The judge said such efforts were certainly part of the officials' scope of normal duties.

So apparently ruining someone's career and putting the fate of the US and possibly other nations in the crapper for your own person gain is part of the normal scope of duties
